1. Acceptance of Terms

By accessing and using LocumLead ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

LocumLead is an online marketplace connecting healthcare facilities with qualified medical professionals for locum (temporary) positions in South Africa. We facilitate the connection between parties but are not party to any employment or service agreement between facilities and clinicians.

3. User Accounts

3.1 Registration

To use our services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Types

  • Clinician Accounts: For medical professionals seeking locum work
  • Facility Accounts: For healthcare facilities seeking locum staff

3.3 Verification

Clinicians must complete our verification process, which includes validation of medical qualifications, HPCSA registration, and professional references. Facilities must provide proof of registration and appropriate licensing.

4. User Responsibilities

4.1 Clinicians

  • Maintain valid HPCSA registration and appropriate insurance
  • Provide accurate information about qualifications and experience
  • Honour confirmed bookings or provide reasonable notice of cancellation
  • Submit accurate timesheets and attendance records
  • Comply with facility policies and professional standards

4.2 Facilities

  • Provide accurate job descriptions and requirements
  • Maintain appropriate insurance and indemnity cover
  • Process timesheets and payments promptly
  • Provide safe working conditions
  • Honour confirmed bookings

5. Bookings and Payments

All payments for locum services are made directly between facilities and clinicians. LocumLead does not process payments on behalf of users. We provide tools to track timesheets and generate invoices, but payment arrangements are between the contracting parties.

6. Cancellation Policy

  • Cancellations with more than 48 hours notice: No penalty
  • Cancellations with 24-48 hours notice: May affect user rating
  • Cancellations with less than 24 hours notice: May result in account restrictions

7. Reviews and Ratings

Users may leave honest reviews after completed bookings. Reviews must be truthful and professional. We reserve the right to remove reviews that violate our guidelines.

8. Prohibited Conduct

Users must not:

  • Provide false or misleading information
  • Circumvent the platform to avoid proper documentation
  • Harass, abuse, or discriminate against other users
  • Use the platform for illegal purposes
  • Attempt to compromise platform security

9. Intellectual Property

All content, features, and functionality of the Platform are owned by LocumLead and protected by intellectual property laws. Users may not copy, modify, or distribute platform content without permission.

10. Limitation of Liability

LocumLead acts as an intermediary platform and is not liable for:

  • The quality of services provided by clinicians
  • The conduct of facilities or clinicians
  • Payment disputes between parties
  • Any damages arising from the use of our platform

To the maximum extent permitted by law, LocumLead's liability is limited to the fees paid to us in the 12 months preceding any claim.

11. Indemnification

You agree to indemnify and hold harmless LocumLead, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the platform or violation of these terms.

12. Privacy

Your use of LocumLead is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

13. Modifications to Terms

We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the modified terms. We will notify users of significant changes via email or platform notification.

14. Termination

We may suspend or terminate accounts that violate these terms. Users may close their accounts at any time, subject to completing any outstanding obligations.

15. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.
